7. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of CA, without regard to its conflict of law provisions.
8. Binding Arbitration
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products or services provided by PCBOIIX, including any question regarding the existence, validity, or termination of these Terms, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in the State of CA, unless otherwise agreed by the parties.
The arbitrator shall have exclusive authority to resolve all disputes, including any claim that all or any part of these Terms is void or voidable. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You may opt out of this arbitration agreement by sending written notice to us within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
9. Class Action Waiver
YOU AND PCBOIIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.
Unless both you and PCBOIIX agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class, collective, or representative proceeding. If this class action waiver is found to be unenforceable for any reason, then the arbitration agreement in Section 8 shall be null and void with respect to such proceeding, and the parties agree to have that proceeding resolved in a court of competent jurisdiction.
You agree to waive any right to a jury trial for any claim covered by this agreement.
